1 Who we are
Stack Up Fantasy ("Stack Up," "we," "us," "our") is a free-to-enter daily-pick fantasy sports game operated by Stack Up Fantasy LLC, a limited liability company formed under the laws of Ohio, the United States. You can reach us anytime at contact@stackupfantasy.com.
2 What Stack Up is — and isn't
Stack Up is a game of skill. Each day you pick one player per stat category, and you accumulate that player's real-world statistics over a season or a defined period. How you do depends on your knowledge and judgment — which players to pick, when, and against which matchups.
- Stack Up is not gambling, betting, wagering, a sportsbook, or a game of chance. Outcomes are driven by skill, not by a random draw.
- There are no entry fees and no purchases. You never pay to enter a contest or to win a prize, and paying us money will never improve your chances of winning.
- You are competing against other players based on skill — never against a "house," and there is no house edge.
3 Eligibility
Stack Up is free to play and open to players around the world. Because it costs nothing to enter and involves no wagering, most people, in most places, can play. A few rules apply:
- You must be at least 18 years old. Some places set a higher minimum age, and where they do, that higher age applies to you — in the United States, for example, you must be at least 19 in Alabama and Nebraska, and at least 21 in Mississippi. Stack Up is not directed to, and may not be used by, anyone under the applicable minimum age.
- You must provide accurate registration information, including a date of birth and your country, state, or region, which we use to confirm eligibility.
- One account per person. You may not create multiple accounts or let anyone else use yours.
- Stack Up is not available where playing it would be prohibited by law. You are responsible for knowing whether participation is permitted where you live.
Who can receive prizes
Free play is open worldwide, but the ability to receive a prize payment depends on where you are — because we, as a U.S. company, must follow U.S. law on where we can send money. Prizes cannot be paid to residents of jurisdictions subject to comprehensive U.S. sanctions, which currently include Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine, or to anyone in any other place where U.S. law or other applicable law prohibits us from sending prize payments. Because sanctions and other laws change, we may update this list and our prize eligibility at any time. Where we cannot lawfully pay a prize, you may still play for fun, but no prize will be awarded or owed.
We may refuse, suspend, or close any account, or withhold a prize, if we believe a user is ineligible, is accessing Stack Up or claiming a prize from a prohibited location, or has broken these Terms.
4 Your account
- You're responsible for everything that happens under your account and for keeping your login secure.
- Sign-in and contact details (email and phone) are handled by our authentication provider, Clerk. Your use of those features is also subject to Clerk's terms.
- Tell us promptly at contact@stackupfantasy.com if you believe your account has been accessed without permission.
How to delete your account and data
You can delete your Stack Up account and associated data at any time:
- In the app: open the Profile tab, scroll to the bottom, tap Delete account, type DELETE to confirm, and confirm. Your account is deleted and you are signed out immediately. If you are the commissioner of an active league that still has other members, you will first be asked to delete or hand off that league.
- By email: if you no longer have the app installed, email contact@stackupfantasy.com from your account's email address with the subject “Delete My Account,” and we will process your request.
What is deleted: your profile (display name, email, avatar), your personal details (legal name, date of birth, phone, and residence), your picks, scores, and standings, your fantasy rosters, lineups, and draft selections, your league memberships, and your chat messages and notifications.
What is retained: to meet legal and contest-integrity obligations, a limited set of records — such as age and rules attestations and shared league trade history — is kept in de-identified form, no longer linked to your identity, and only for as long as required by law and our contest rules.
5 Prizes & how winning works
Stack Up contests are free to enter and may award prizes, including cash or cash-equivalent prizes. The following apply to every prize contest:
- No purchase or payment, ever. Entry is always free. No purchase or payment of any kind is required to enter or to win, and no payment will improve your chances.
- Skill decides winners. Winners are determined by the accumulated statistical performance of the players you pick — not by chance.
- Each contest has its own rules. Every prize contest posts its own rules stating the prize, its value, the entry period, eligibility, and how winners are determined and notified. If those rules ever conflict with these Terms, the contest rules control for that contest.
- Sponsor. Unless a contest says otherwise, the sponsor is Stack Up Fantasy LLC. Apple Inc. is not a sponsor of, and is not involved in any way with, any Stack Up Fantasy contest, and Apple has no responsibility for any contest, entry, prize, or dispute arising from it.
- Taxes are the winner's responsibility. Prizes may be taxable. You are solely responsible for any taxes on prizes you win. Where the law requires, we may withhold taxes and may require you to provide tax information (for example, an IRS Form W-9 in the United States) before we pay a prize. In the U.S., we may be required to report total prizes of $600 or more paid to one person in a calendar year.
- Verification & forfeiture. We may verify a winner's identity, age, and location before paying. We may withhold or revoke a prize if a winner is ineligible, broke these Terms or the contest rules, gave false information, or can't be verified or reached within a reasonable time.
6 Fair play
To keep Stack Up fair for everyone, you agree not to:
- Cheat, collude, exploit bugs, or use bots or automated tools to gain an advantage;
- Create multiple accounts, share accounts, or enter on someone else's behalf;
- Access Stack Up from a prohibited location, or use a VPN or similar tool to disguise your location;
- Harass other players, post unlawful or infringing content, or try to access accounts that aren't yours;
- Scrape, reverse-engineer, overload, or disrupt the service or its infrastructure.
7 Sports data & scoring
Stack Up relies on third-party providers for live sports data. We work to keep scoring accurate, but we don't guarantee that data, statistics, or scoring are error-free or always available. If a data provider issues a correction or revision, we may adjust scores accordingly, including after a contest appears to have ended.
8 Intellectual property
Stack Up and its content, logos, and software are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-exclusive license to use Stack Up for personal, non-commercial play. You keep ownership of content you submit, and you grant us a license to host and display it as needed to run the service.
9 Third-party services
Stack Up depends on outside providers for hosting, authentication, sports data, and notifications. We're not responsible for the accuracy, availability, or conduct of third parties, and their own terms and privacy practices apply to their part of the service.
10 Disclaimers
Stack Up is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, secure, or error-free, or that scoring and statistics will always be accurate.
11 Limitation of liability
To the fullest extent permitted by law, Stack Up Fantasy LLC, its members, and its people won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising from your use of Stack Up. To the fullest extent permitted by law, our total liability for any claim relating to the service won't exceed USD $100. Some places don't allow certain limitations, so parts of this may not apply to you.
12 Indemnification
You agree to indemnify and hold harmless Stack Up Fantasy LLC and its people from any claims, damages, or expenses (including reasonable legal fees) arising from your use of Stack Up, your breach of these Terms, or your violation of any law or the rights of anyone else.
13 Suspension & termination
You can stop using Stack Up and delete your account at any time. We may suspend or close accounts at our discretion, including for suspected ineligibility or rule-breaking. Sections that should survive — including disclaimers, limitation of liability, and indemnification — continue to apply after termination.
14 Changes to these Terms
We may update these Terms from time to time. For material changes, we'll update the "Last updated" date and, where appropriate, give notice in the app. If you keep using Stack Up after changes take effect, you accept the updated Terms.
15 Governing law & disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.
Arbitration & class-action waiver
Please read this section carefully — it affects how disputes between you and Stack Up are resolved and limits your rights.
Except for the matters described below, you and Stack Up agree that any dispute, claim, or controversy arising out of or relating to these Terms or to Stack Up will be resolved by binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its applicable consumer rules, and may take place in Cuyahoga County, Ohio, or — at your election — in your home county or by video or phone where the rules allow.
Class-action waiver. You and Stack Up agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect its intellectual property or stop misuse of the service. Nothing here prevents you from bringing matters to the attention of government or regulatory authorities.
Your right to opt out. You may opt out of this arbitration agreement by emailing contact@stackupfantasy.com within 30 days of first accepting these Terms, with your name and a clear statement that you wish to opt out of arbitration. Opting out won't affect any other part of these Terms.
If the class-action waiver is found unenforceable as to a particular claim, that claim — and only that claim — will proceed in court rather than in arbitration. For any claims not subject to arbitration, you and Stack Up consent to the exclusive jurisdiction of the state and federal courts located in Cuyahoga County, Ohio, except where the law where you live gives you the right to bring a claim locally.
